CONSENT FOR MINORS
Law #139 of August 1, 2019, known as the Consent by Representation for Non-Urgent Medical Treatment of Minors Act, allows parents with parental authority or legal guardians to authorize a competent adult to accompany the minor to receive NON-URGENT medical treatment.
COMPETENT – An adult with full knowledge and decision-making skills.
A minor is considered any patient from 0–21 years old, except patients who are legally married or emancipated.
WHAT IS NON-URGENT MEDICAL TREATMENT?
These are medical treatments that are not emergencies. They include routine treatments or follow-up visits; for example: outpatient services, dental services, X-rays, physical exams, laboratory tests, immunizations, or medical appointments.
WHAT DO I NEED TO DO SO THAT A MINOR CAN COME ACCOMPANIED BY A COMPETENT ADULT?
- You must go to the Information Management Department to complete the form.
- The person with parental authority must be competent.
- At least one of the individuals with parental authority must sign the document. BEFORE THE DATE THE MINOR WILL RECEIVE THE SERVICE.
The law DOES NOT allow parents/legal guardians to present a letter stating they authorize a family member to accompany the minor to receive NON-URGENT medical services. Only the document created by the Department of Health is accepted. This can be completed at the Information Management Department.
TO COMPLETE THE DOCUMENT, YOU MUST PRESENT/HAVE ON HAND THE FOLLOWING:
- Official photo ID (driver’s license, passport, or other government-issued ID from PR or any state with photo and signature).
- Name, address, phone number, and a copy of the photo ID of the competent adult who will be authorized to accompany the minor.
This document does not apply in cases where laws require the minor to receive treatment alone (obstetrics, sexually transmitted diseases, family planning, etc.). It also does not apply to services in the Emergency Room.
It is important that the adult authorized to accompany the minor for non-urgent medical treatment provide valid identification when accompanying the minor.
